1. Introduction
Welcome to Alignment Exercise Physiology. By accessing or using our website (www.alignmentexercisephysiology.com.au) and/or our services, you agree to be bound by these Terms of Service, all applicable laws and regulations, and acknowledge that you are responsible for complying with all applicable laws. Please read these terms carefully. If you do not agree to these Terms of Service, you must not access or use our website or services.
2. Services Provided
Alignment Exercise Physiology provides Exercise Physiology services, Myofascial Release Therapy, and online educational programs to assist with the management of persistent pain, chronic health conditions, disability, injury rehabilitation and prevention, and general health and wellbeing. Services are tailored to each individual's health needs and goals.
3. Appointments and Cancellations
3.1. Booking Appointments
Appointments can be booked through our website, by phone, or in person. We require accurate personal information to secure your booking.
A booking deposit is required to secure your initial consultation. The deposit is non-refundable but will be applied towards the cost of your appointment. The required deposit amount will be clearly communicated during the booking process.
Booking deposit requirements may be waived or varied for clients funded through third-party schemes (including NDIS, DVA, WorkCover, CTP, or other compensable funding arrangements) at Alignment Exercise Physiology's discretion.
3.2. Cancellation Policy
To ensure fairness and appointment availability for all clients, we require a minimum of 24 business hours' notice for any appointment cancellations or rescheduling requests. Notice provided outside of business hours will be deemed to have been received on the next business day.
New Clients: Booking deposits are non-refundable. If at least 24 business hours' notice is provided, your booking deposit will be retained as a credit and can be transferred to a future appointment. If less than 24 business hours' notice is provided, or you do not attend your appointment, the booking deposit will be forfeited.
Existing Clients: Appointments cancelled, rescheduled, or unattended with less than 24 business hours' notice may incur a cancellation fee equal to 50% of the scheduled service fee.
Alignment Exercise Physiology reserves the right to waive cancellation fees or transfer booking credits in exceptional circumstances.
4. Payment Terms
4.1. Fees
Unless otherwise specified, consultation fees are payable at the time of your appointment. Where a booking deposit is required, it must be paid at the time of booking and will be applied towards the total consultation fee.
4.2. Payment Methods
We accept various payment methods including credit cards, debit cards, and cash.
5. Privacy and Confidentiality
Your privacy is important to us. Please review our Privacy Policy which explains how we collect, use, and protect your information.
6. User Responsibilities
You agree to use our services for lawful purposes and in accordance with these Terms of Service. You must provide accurate and complete information when registering and notify us of any changes.
7. Limitation of Liability
To the fullest extent permitted by law, Alignment Exercise Physiology shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our services. This includes, but is not limited to, damages for loss of data or profit, or due to business interruption.
8. Intellectual Property
All content, trademarks, and data on this website, including but not limited to text, graphics, and logos, are the property of Alignment Exercise Physiology and are protected by applicable intellectual property laws.
9. Governing Law
These terms are governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
10. Changes to Terms of Service
We reserve the right to modify these Terms of Service at any time. Any changes will be posted on our website, and where appropriate, notified to you by email. Your continued use of our services following any changes indicates your acceptance of the new terms.
11. Health and Safety
11.1. Client Responsibilities
Clients are expected to inform our practitioners of any pre-existing medical conditions, injuries, or other health-related issues that may affect their ability to participate in exercise programs. Clients are responsible for informing their practitioner of any medical conditions, injuries, medications, pregnancy, or other factors that may affect their participation. Failure to provide relevant information may affect the safety or effectiveness of treatment.
11.2. Medical Disclaimer
The content and services provided by Alignment Exercise Physiology, including Exercise Physiology and Myofascial Release Therapy, are not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your medical practitioner or other qualified healthcare provider regarding any medical condition or concerns.
11.3 Myofascial Release Therapy
Myofascial Release Therapy is a hands-on treatment involving sustained pressure and manual techniques applied to soft tissues. While every effort is made to provide treatment safely and professionally, some clients may experience temporary soreness, tenderness, fatigue, or a short-term increase in symptoms following treatment. Individual responses vary, and no guarantee of specific outcomes can be made. Clients are encouraged to communicate any discomfort during treatment so techniques can be modified as appropriate.
12. Dispute Resolution
12.1. Dispute Resolution Process
In the event of a dispute, both parties agree to first attempt to resolve the issue through informal negotiation. If a resolution cannot be reached, the dispute will be referred to mediation before pursuing any other legal remedies.
13. Right to Refuse Service
Alignment Exercise Physiology reserves the right to refuse service to anyone for any reason that does not contravene anti-discrimination laws. This includes, but is not limited to, situations where:
The client is unable or unwilling to provide accurate health information.
The client is disruptive or poses a safety risk to staff or other clients.
The client exhibits rude or inappropriate behaviour towards staff or other clients.
The client fails to comply with the terms and conditions of service.
14. Online Courses and Digital Products
14.1 Overview
Alignment Exercise Physiology offers online educational courses, including but not limited to:
Unstuck: Back Pain Edition
Take Back Control: Back Pain Recovery Program
These courses are provided as self-paced, digital education programs designed to support understanding and management of persistent back pain.
14.2 Nature of Services
Our online courses are educational in nature and do not constitute individualised exercise physiology, medical advice, diagnosis, or treatment.
Participation in any course does not establish a practitioner–client relationship.
The information provided is general in nature and may not be suitable for all individuals.
14.3 Access and Use
Upon purchase, users are granted access to the course content via a secure online platform or app.
Access is for personal, non-commercial use only and must not be shared, distributed, reproduced, or resold.
We reserve the right to suspend or terminate access if misuse is identified.
14.4 Results and Expectations
While our courses are based on professional knowledge, research, and clinical experience, we do not guarantee specific outcomes.
Individual results will vary depending on a range of factors including health status, consistency, and personal circumstances.
14.5 Refund Policy (specific to the online courses only)
For Unstuck: Back Pain Edition, a full refund is available if requested within 7 days of purchase.
For Take Back Control: Back Pain Recovery Program, a refund is available if requested within 30 days of purchase. Refunds will be issued for the full purchase amount minus any non-refundable payment processing fees incurred at the time of purchase.
These processing fees are charged by third-party payment providers (e.g. Stripe and platform fees) and are not retained by Alignment Exercise Physiology, therefore they cannot be recovered or refunded.
14.6 User Responsibility
By enrolling in an online course, you acknowledge that:
You are responsible for applying the information appropriately.
You will not continue any activity that causes significant or worsening symptoms.
You will seek appropriate medical advice where necessary.
14.7 Technical Access
We are not responsible for temporary interruptions to access due to platform issues, internet connectivity, or third-party services.
